Banking power of attorney in the UAE
A banking power of attorney authorises the agent to carry out specified operations with a bank on the principal’s behalf, where the bank allows it. We prepare the power of attorney and coordinate its notarization route.
Naming the operations
Article 871 of the UAE Civil Transactions Law, issued by Federal Decree-Law No. 25 of 2025 and in force since 1 June 2026, provides that a power of attorney in general terms authorises acts of administration only, and Article 870 requires a special power of attorney specifying the type of act for every act outside administration and preservation. A banking power of attorney therefore names the bank and the operations the agent may carry out.
The bank’s requirements
- Each bank decides, under its own policies, whether to accept a power of attorney and which operations it allows the agent to carry out.
- Under Central Bank guidance, banks verify that any person acting on behalf of a customer is authorised, and verify that person’s identity.
What we need to prepare the power of attorney
- Principal’s Emirates ID or passport.
- The bank name and the account number.
- Agent’s full name, nationality, and Emirates ID or passport number.
- The banking operations to be authorised.
Notarization
We coordinate the appropriate notarization route through Dubai Courts or the relevant federal channel, depending on the POA and the principal’s details.
- At Dubai Courts, remote notarization requires a valid Emirates ID.
- If the party holds a passport only, without an Emirates ID, Dubai Courts requires personal attendance before the notary public.
Steps
- Send the documents over WhatsApp or email.
- We prepare the power of attorney in the appropriate format for notarization based on the transaction details.
- You review and approve the draft.
- The principal completes the required notarization or signing step through the applicable channel.
