Eviction notice for demolition and rebuilding in Dubai
The eviction rules for demolition depend on the reason for it. Where the owner wishes to demolish and rebuild the property, eviction is requested at the end of the tenancy contract, subject to the notice period set by law. Where the property is liable to collapse, or a government authority decides on demolition for urban development, different rules apply before the contract ends. Owner’s demolition and rebuilding, at the end of the contract
Article 25(2)(a) of Dubai’s tenancy law, Law No. 26 of 2007 as amended by Law No. 33 of 2008, allows the landlord to seek eviction at the end of the tenancy where the owner wishes to demolish and rebuild the property, or to add new buildings that prevent the tenant from using it, provided the required licences are obtained from the competent authorities.
The notice must meet these requirements:
- Served on the tenant at least 12 months before the date set for eviction.
- States the reasons for eviction.
- Served through the notary public or by registered mail.
Building liable to collapse, before the contract ends
Article 25(1)(g) allows eviction before the tenancy ends where the property is liable to collapse, proven by a technical report issued or approved by Dubai Municipality. The notice is served through the notary public or by registered mail.
Urban development requirements, before the contract ends
Article 25(1)(i) allows eviction before the tenancy ends where urban development requirements in the Emirate call for demolishing and rebuilding the property, as decided by the competent government authorities. The notice is served through the notary public or by registered mail.
Tenant’s priority to return
The tenant has priority to return to the property if the landlord demolishes and rebuilds it, or renews and restores it, at a rent set in accordance with Article 9 of the law. The tenant exercises this priority within thirty days from the date of the landlord’s notice (Article 29).
What we need to prepare the notice
- Owner’s Emirates ID or passport.
- Title deed.
- Tenancy contract.
- Depending on the case: demolition or construction licences if issued, the Dubai Municipality technical report, or the decision of the competent government authority.
- Tenant’s name and the property address.
- The date set for eviction, where the eviction is at the end of the contract.
Certification by the notary public
- The notice is certified by the notary public at Dubai Courts under its legal notices service.
- Remote processing requires a valid Emirates ID.
- If the party holds a passport only, without an Emirates ID, the service requires personal attendance before the notary public.
