Eviction notice for personal use in Dubai

If the owner of a leased property in Dubai wishes to recover it for personal use, or for use by a first-degree relative, the landlord may request the tenant’s eviction at the end of the tenancy contract. We prepare the notice and follow its certification by the notary public at Dubai Courts and its service on the tenant.

Legal basis

Article 25(2)(c) of Dubai’s tenancy law, Law No. 26 of 2007 as amended by Law No. 33 of 2008, allows the landlord to seek eviction at the end of the tenancy where the owner wishes to recover the property for personal use, or for use by a relative up to the first degree.

Leasing the property after recovery

Where the landlord is granted recovery of the property under Article 25(2)(c), the landlord may not lease it to others until at least two years have passed for residential property, or three years for non-residential property, from the date of recovery, unless the tribunal orders a shorter period for reasons it considers. Otherwise, the tenant may request a ruling for fair compensation (Article 26).
