Eviction notice for sale of property in Dubai
If the owner of a leased property in Dubai wishes to sell it, the landlord may request the tenant’s eviction at the end of the tenancy contract, after notifying the tenant at least 12 months in advance. We prepare the notice and follow its certification by the notary public at Dubai Courts and its service on the tenant.
Legal basis
Article 25(2)(d) of Dubai’s tenancy law, Law No. 26 of 2007 as amended by Law No. 33 of 2008, allows the landlord to seek eviction at the end of the tenancy where the owner wishes to sell the property.
Notice requirements
- Served on the tenant at least 12 months before the date set for eviction.
- States the reasons for eviction.
- Served through the notary public or by registered mail.
Sale before the tenancy ends
Transfer of ownership to a new owner does not affect the tenant’s right to continue occupying the property under the tenancy contract concluded with the previous owner, provided the contract has an established date (Article 28).
What we need to prepare the notice
- Owner’s Emirates ID or passport.
- Title deed.
- Tenancy contract.
- Tenant’s name and the property address.
- The date set for eviction.
Certification by the notary public
- The notice is certified by the notary public at Dubai Courts under its legal notices service.
- Remote processing requires a valid Emirates ID.
- If the party holds a passport only, without an Emirates ID, the service requires personal attendance before the notary public.
Steps
