Notice to pay rent and eviction for non-payment in Dubai
A landlord’s request to evict a tenant in Dubai for unpaid rent starts with a formal notice to pay. We prepare the notice and follow its certification by the notary public at Dubai Courts and its service on the tenant.
Legal basis
Article 25(1)(a) of Dubai’s tenancy law, Law No. 26 of 2007 as amended by Law No. 33 of 2008, allows the landlord to seek the tenant’s eviction before the tenancy ends where the tenant does not pay the rent, or any part of it, within thirty days of being notified to pay, unless the parties agree otherwise.
Notice requirements
- Demands payment of the rent due.
- Served through the notary public or by registered mail.
- The thirty days are counted from the date of the notice.
After the thirty days
If the thirty days pass without payment, the landlord may file the eviction request with the Rental Disputes Center (RDC). Filing an eviction case does not exempt the tenant from paying the rent for the whole period of the case, the ruling and its execution (Article 31).
What we need to prepare the notice
- Landlord’s Emirates ID or passport.
- Tenancy contract.
- The unpaid rent: amounts and due dates.
- Tenant’s name and the property address.
Certification by the notary public
- The notice is certified by the notary public at Dubai Courts under its legal notices service.
- Remote processing requires a valid Emirates ID.
- If the party holds a passport only, without an Emirates ID, the service requires personal attendance before the notary public.
Steps
